Dominio minero y reserva de litio en Chile. Una indagación histórica para el debate constituyente

El presente trabajo se propone analizar la transformación que sufrió el sistema de dominio minero en Chile entre 1973 y 1983 y su relación con la reserva de litio instaurada en 1975 y reformulada en 1979. Para ello, luego de repasar los principales antecedentes históricos y normativos del dominio minero de tipo estatal que estuvo vigente hasta 1973, se analizará el proceso de restauración ultraliberal y su relación contradictoria con la reserva estatal dictada sobre el litio, en función de tres períodos históricos consecutivos: 1973-1975, 1975-1980 y 1980-1983. Se trata así de reflexionar sobre la compleja relación entre el sistema de dominio minero definido por las leyes de fondo y las políticas mineras específicas que cada gobierno dicta para regular el acceso y usufructo de los minerales estratégicos.

The purpose of this paper is to analyze the transformation of the mining dominion system in Chile between 1973 and 1983 and its relationship with the lithium reserve established in 1975 and reformulated in 1979. For this matter, after reviewing the main historical and regulatory background of the state mining domain that was in force until 1973, the ultraliberal restoration process and its contradictory relationship with the state reserve dictated on lithium will be analyzed in terms of three consecutive historical periods: 1973-1975, 1975-1980 and 1980-1983. The aim is to reflect on the complex relationship between the mining domain system defined by substantive laws and the specific mining policies that each government dictates to regulate access to and use of strategic minerals.
